– that was defective or a service that you never received, the Law
Office of Shane McClelland may be able to help you. You may have a consumer

or expectations as it was presented to you. If you asked for something

as required, we can help you pursue a claim. We’re here to walk
with you every step of the way.
Consumer Rights Under the Texas Deceptive Trade Practices Act
The Texas Deceptive Trade Practices Act (DTPA) allows consumers to pursue
compensation for the harm they’ve suffered because of a business
using fraud, misrepresentation, exaggeration, or other deceptive statements
or practices to harm a consumer. It also allows people to pursue attorney’s
fees in these types of cases.
The DTPA covers a wide variety of business transactions that range from
simple retail purchases to wrongful foreclosure and even
wrongful deaths due to product defects. Depending on the facts of the case and the outcome
at trial, a consumer may be entitled to “treble damages.”
Treble damages are a recovery of three times the amount of actual financial
losses suffered, which is provided by the TDTPA statute because the business
knowingly or intentionally acted wrongfully.
Consumer law claimants under The Texas Deceptive Trade Practices Act may
be able to recover compensation for:
- Injuries suffered
- Property damage
- Mental anguish
