Federal Racial Discrimination Laws
It is illegal to discriminate against an employee because of that employee’s
race under Title VII and the Civil Rights Act of 1866, 42 U.S.C. §1981.
An employer must have 15 employees for either Title VII or the Texas Labor
Codes provisions protecting racial discrimination to apply.
Employers cannot discriminate against an employee because of race or color
- Job training
Title VII also prohibits discrimination based on stereotypes and assumptions
about the abilities of individuals of certain racial groups.
Like other forms of discrimination, it is unlawful to retaliate against
an employee who has filed a discrimination claim or otherwise opposes
any employment practices that discriminate because of race. This means
that you cannot be fired, demoted, or otherwise mistreated simply because
you have filed a discrimination claim.
File a Claim Today
If you bring a racial discrimination claim under Title VII, you must first
file a charge of discrimination with either the Texas Workforce Commission
or the Equal Employment Opportunity Commission. Keep in mind that there
are certain deadlines you must meet if you intend to file a charge of
discrimination. The Law Office of Shane McClelland can help determine
if you have a valid claim and can ensure that you file your claim or lawsuit
in a timely fashion.
