Federal Wage Laws
The federal law that regulates employees’ wages is called the Fair Labor Standards Act (FLSA). The FLSA establishes minimum wage, overtime pay, and recordkeeping requirements for employees. Covered nonexempt employees are entitled to a minimum wage and overtime pay at a rate of not less than one and one-half times the regular rate of pay for more than 40 hours of work in a workweek. There are exceptions when an employee is not entitled to minimum wage or overtime pay. For example, employees who are bona fide executives, administrators, or professional and some outside sales employees are exempt from the FLSA’s minimum wage and overtime requirements. To be exempt, employees must have certain job duties and be paid on a salary basis at not less than $455 per week. It is important to keep in mind that job titles don’t determine whether an employee is exempt or not.
